Software Publisher’s
GENERAL TERMS OF USE
These Terms of Use (the “Terms”) govern your access to and use of TRENDEX.ONE, a decentralized, non-custodial, blockchain-based prediction protocol (the “Protocol”), including software and any related user interfaces made available by the publisher, MINDMETRICS INTERNATIONAL (the „Software Publisher“) on www.trendex.one site solely for the purpose of accessing the Protocol (the “Software”) that may be available to users by connecting their self-hosted wallets via an Interface, including but not limited to the site (the “Technology Features”).
Under applicable franchise agreement, the Software publisher has the right to use the Software, to distribute the Software, provide communications tools and provide infrastructure that users can independently use. The Software Publisher owns all rights to exploit the intellectual property rights in and to the Protocol and any Technology Features and hereby grants to the user a personal, limited, revocable, non-exclusive, non-sublicensable, non-transferable license to use the Protocol and any Technology Features. This license is solely intended to allow the user to access, use and interact with the Protocol and any Technology Features.
The Protocol consists of open-source, permissionless smart contracts deployed on public blockchain infrastructure.
The Software and Platform are provided solely as a technological solution enabling users to interact with Technology Features. The Software Publisher does not provide financial services, investment services, payment services, money transmission services, custody, safekeeping, brokerage, or any regulated financial activity.
The Software Publisher does not take possession, custody, or control of users’ digital assets, private keys, funds, or wallets, and does not act as a trustee, fiduciary, or financial intermediary on behalf of any user.
If you are in a Restricted Jurisdiction, you must not use the Protocol or any other interface for any purpose and you must not access the Technology Features, including and in particular the Protocol.
By accessing or using the Protocol, you acknowledge that you have read, understood, and agree to be bound by these Terms.
- You acknowledge and agree that:
- The Protocol is non-custodial.
- The Software Publisher grants to the user a personal, limited, revocable, non-exclusive, non-sublicensable, non-transferable license to use the Protocol and any Technology Features.
- User interacts with the Protocol using self-hosted wallets. User should note that the Software Publisher:
- is not involved in providing or transmitting any such information to networks,
- cannot transmit any information to networks or otherwise assist in any transaction,
- never has access to and cannot control or provide guarantees relating to user’s wallet and
- has no authority over and does not take possession or custody of user’s crypto assets at any time.
- Smart contracts operate autonomously once deployed, neither the Software Publisher nor any third party operates, controls, or administers the Protocol after deployment.
- All transactions are executed directly on public blockchains. The core smart contracts of the Protocol are immutable. The software underlying blockchain networks, including the BASE network, is open source, such that anyone can use, copy, modify, and distribute it. In particular: no administrative keys exist, no proxy contracts or upgrade mechanisms exist, no pause, freeze, or emergency controls exist (except Art 12). Once deployed, the Protocol functions without ongoing control, discretion, or intervention by any party, including the Software Publisher.
- As a condition to accessing or using the Protocol, you represent and warrant to the Software Publisher the following:
- You are 18 years of age or older.
- You are not under following sanctions: economic or trade sanctions administered or enforced by any governmental authority or are included on the list of specially designated nationals and blocked persons maintained FATF black & grey-list countries: https://www.fatf-gafi.org/en/countries/black-andgrey-lists, as well as permanent IP block of the following countries: Algeria, Angola, Bolivia, Bulgaria, Cameroon, Costa Rica, Cuba, Democratic Republic of the Congo, France, Germany, Haiti, Ivory Coast, Kenya, Laos, Lebanon, Monaco, Namibia, Nepal, Nicaragua, Panama, Singapore, South Sudan, Venezuela, Vietnam, Virgin Islands, United Arab Emirates, United Kingdom, Yemen (the “Restricted Jurisdiction“).
- You represent and warrant that you are solely responsible for safety of your wallet.
- You agree that the applicable law will be Costa Rican law, which is the Software Publisher’s country of establishment.
- You are aware that using the Protocol to enter into contracts, you can lose up to the entire amount of the crypto assets supplied to the contract.
- You expressly acknowledge and agree that neither the Protocol nor the Software Publisher:
- Operates a crypto asset exchange or derivatives exchange.
- Executes, matches, clears, or settles transactions.
- Acts as a broker, dealer, agent, intermediary, or counterparty.
- Accepts or transmits funds on behalf of users.
- Sets prices, odds, outcomes, or market terms.
- Provides investment, trading, legal, tax, or financial advice.
- You acknowledge and agree that all interactions with the Protocol:
- Are initiated by users.
- Are signed by users using their own wallets. User is solely responsible for familiarizing himself with his Wallet and its safety and security features, including any private keys and passwords associated therewith. The Software Publisher will not and cannot access user’s private key, password, or any crypto assets held within user’s wallet nor can it reverse any transactions user initiates with his wallet.
- Are broadcast to the blockchain by users or their wallet providers.
- The Software publisher does not initiate, relay, broadcast, censor, delay, or reverse transactions. Blockchain transactions are irreversible.
- Any Technology Features are provided solely as a technical access point to interact with the Protocol.
- You acknowledge and agree that:
- Use of the Protocol is optional.
- The Protocol may be accessed independently of the technical interface.
- The Interface does not control blockchain networks, wallets, or third-party services.
- The Protocol or any interface does not custody funds, submit transactions, or enforce protocol rules.
- Displayed information may be delayed, incomplete, or inaccurate.
- The Technical Interface does not function as a gatekeeper and is not required to use the Protocol.
- You acknowledge and agree that any fees or economic mechanisms associated with the Protocol:
- Are enforced entirely by immutable smart contract logic.
- Are transparent and verifiable on-chain.
- Are not set, adjusted, or collected by the Software Publisher through off-chain means.
- No fees pass through wallets controlled by the Software Publisher.
- You acknowledge and agree that you are solely responsible for:
- Maintaining control of your private keys. Loss of private keys or user error may result in permanent loss of assets.
- Reviewing transaction parameters before submission.
- Understanding the Protocol’s mechanics (Art 1.5).
- Complying with all applicable laws and regulations in your jurisdiction.
- You acknowledge and agree that:
- The Protocol constitutes Software, not a regulated financial service.
- Regulatory treatment of blockchain technology varies by jurisdiction.
- The Software Publisher does not act as a money services business, exchange, broker, or clearing organization by publishing or maintaining the Software.
- Nothing in these Terms relieves users of their own regulatory obligations.
- You acknowledge and agree that use of the Protocol involves risks, including but not limited to:
- Smart contract vulnerabilities. User should also familiarize himself with the risks associated with transacting on blockchain networks, including but not limited to smart contract vulnerabilities, front end vulnerabilities, hacks, phishing attacks, social engineering attacks, crypto asset volatility and transaction irreversibility.
- Blockchain congestion or failure.
- Oracle or data-source risks.
- Regulatory uncertainty.
- Market volatility or outcome disputes.
- You assume all risks associated with use of the Protocol.
- THE SOFTWARE AND PROTOCOL ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- To the maximum extent permitted by law, the Software Publisher shall not be liable for any direct or indirect losses arising from:
- Use or licensing of the Protocol.
- Smart contract behavior.
- Blockchain network issues.
- User error or misuse.
- The Software Publisher may, at its sole discretion and without prior notice, temporarily suspend or limit access to all or part of the Platform or Software functionalities where reasonably necessary to:
(a) address security incidents, vulnerabilities, or technical failures;
(b) prevent fraud, abuse, or unlawful activity;
(c) comply with applicable laws, regulations, or enforcement requests; or
(d) protect the integrity, stability, and proper operation of the Software.
Any such suspension or limitation constitutes a technical and operational measure only and shall not be construed as the provision of financial services or the exercise of custody or control over user assets. - The Software Publisher may restrict or block a user’s ability to interact with certain Platform features, including placing predictions or purchasing tokens from pools, where the user:
(a) fails to complete or pass applicable KYC/AML checks;
(b) is suspected of violating these Terms or applicable law; or
(c) is subject to sanctions, restrictions, or eligibility limitations. Any such restriction applies solely to the user’s access to Software functionalities and does not affect the user’s ownership of, or entitlement to, their digital assets. Users shall remain entitled to claim or withdraw funds in accordance with the Platform’s technical processes, subject to applicable legal requirements.
- By connecting its external wallet to the Protocol/Software, the user accepts the following regulatory and financial disclaimer: Use of the Protocol/Software, including entering into contracts, involves significant financial risk. Contracts are inherently volatile and experimental, and you may lose the entire amount you supply. All contract-related transactions are final, irreversible, and non-refundable. BY USING THE PROTOCOL AND ENTERING INTO CONTRACTS, YOU ACKNOWLEDGE THAT YOU MAY LOSE UP TO 100% OF THE CRYPTOASSETS YOU PROVIDE. By using this Protocol/Software, you agree to comply with all applicable anti–money laundering and counter-terrorist financing laws and regulations. You are solely responsible for ensuring that your use of the Protocol/Software is lawful in your jurisdiction. The Protocol/Software does not guarantee uninterrupted access or the accuracy of prediction information. You must use your own judgment when placing prediction. The Protocol/Software is not liable for any: losses or damages arising from misuse of your account; financial losses resulting from prediction activities, technical failures, service interruptions, or data loss, acts of fraud, theft, or illegal conduct committed by users or third parties. The information, forecasts, markets, pools and data available on this platform are provided for entertainment purposes only and do not constitute financial, investment, trading, or legal advice. You acknowledge and agree that: No content on this Protocol/Software should be interpreted as a recommendation to predict, buy, sell, or hold any asset. Predictions, market probabilities, and user-generated content are inherently uncertain and may be inaccurate or incomplete. Participation in prediction markets involves risk of loss, and you are solely responsible for evaluating such risks. You should consult with a qualified financial advisor before making any financial decisions. You are solely responsible for complying with the laws, regulations, and restrictions of your country of residence or location. The Protocol/Software do not guarantee compliance on your behalf and bear no responsibility for any violation of local regulations. The Protocol/Software make no guarantees regarding outcomes, accuracy of forecasts, or future performance. By using this Protocol/Software, you confirm that you understand these risks and obligations and agree that the platform bears no liability for any financial losses, regulatory issues, or decisions made based on its content.
- These Terms are governed by the laws of Costa Rica and any action related thereto will be governed by the Costa Rican Law for International Arbitration.
